The AlloTools platforms constitute intellectual works protected by applicable intellectual property laws and international regulations. Users may not reuse, transfer, or exploit, for their own account, all or part of the elements or works contained in the AlloTools platforms.

Users agree to access the website using up-to-date hardware free of viruses and a current-generation browser. Users release AlloTools S.A. from liability for any direct or indirect damage caused by use of the services. Responsibility lies solely with the user.

AlloTools S.A., as the site owner, reserves the right to pursue civil and/or criminal proceedings against any user, particularly in the case of racist, offensive, defamatory, or pornographic messages, regardless of the medium used (text, images, etc.). Developers of the website www.allotools.com  retain the IP addresses of users, which may be used to identify them in response to judicial requests.

7. APPLICABLE LAW AND JURISDICTION

Any dispute related to the use of www.allotools.com is subject to French law. Both the user and AlloTools S.A. agree to submit to the exclusive jurisdiction of the Luxembourg courts in the event of a dispute.

8. PROTECTION OF PERSONAL DATA

User: Any individual accessing and using the AlloTools platforms.

The User is informed of the regulations concerning marketing communications, French Law of June 21, 2014 on Confidence in the Digital Economy, the French Data Protection Act of August 6, 2004, as well as the General Data Protection Regulation (GDPR – Regulation (EU) No. 2016/679).

8.1 Data controller

For the personal data collected as part of the creation of the User’s account and during the User’s navigation on the AlloTools platforms, the data controller is: AlloTools S.A.
As the data controller of the personal data it collects, AlloTools S.A. undertakes to comply with the applicable legal framework. In particular, it is the responsibility of AlloTools S.A. to determine the purposes of its data processing activities, to provide its prospects and customers, from the moment their consent is collected, with complete information on the processing of their personal data, and to maintain a record of processing activities that accurately reflects reality.
Each time AlloTools S.A. processes Personal Data, AlloTools S.A. takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which they are processed.

8.2 Purpose of the Data Collected

AlloTools S.A. may process all or part of the following data: 

  • To enable navigation on the AlloTools platforms and to manage and ensure traceability of the services and products ordered by the User: connection and usage data, billing information, order history, etc.
  • To prevent and combat computer fraud: hardware used for navigation, IP address, password (hashed).
  • To improve navigation on the AlloTools platforms: connection and usage data.
  • To conduct optional satisfaction surveys on the AlloTools platforms.

AlloTools S.A. does not sell Users’ personal data. Such data is therefore used solely out of necessity or for statistical and analytical purposes.

8.3 Data Retention Period

Personal data is retained only for the period strictly necessary to fulfill the purposes for which it was collected.
By way of indication, the applicable retention periods are as follows:

  • Customer Management and Commercial Prospecting: Data relating to customers is retained for the entire duration of the contractual or commercial relationship. This period is extended by an additional three (3) years for commercial follow-up and prospecting purposes. After this three-year period, the data is archived for five (5) years following the end of the relationship, in order to comply with the statutory limitation period under ordinary law, before being permanently anonymized.
  • Legal and Accounting Obligations: Accounting and tax-related documents and supporting records are retained for ten (10) years from the close of the relevant financial year, in accordance with applicable legal requirements.

8.4 Right of Access, Rectification and Objection

In accordance with the applicable European regulations, Users of the AlloTools platforms have the following rights: 

  • Right of access (Article 15 GDPR)
  • Right to rectification (Article 16 GDPR)
  • Right to erasure (Article 17 GDPR)
  • Right to object (Article 21 GDPR)
  • Right to restriction of processing (Article 18 GDPR) 
  • Right to data portability (Article 20 GDPR)
  • Right not to be subject to a decision based solely on automated processing, including profiling (Article 22 GDPR)

Requests for the erasure of personal data will be subject to applicable legal obligations relating to data retention or archiving. Where the law requires the retention of certain information, such data will be subject to irreversible anonymization rather than deletion, so that it no longer constitutes personal data.

8.5 Non-Disclosure of Personal Data

AlloTools S.A. undertakes not to process, host, or transfer the information collected about its customers to a country located outside the European Union or to a country not recognized as providing an adequate level of protection by the European Commission, without first informing the customer. AlloTools S.A. further undertakes to take all necessary precautions to preserve the security of such information.

AlloTools S.A. reserves the right to modify this policy at any time, without prior notice, except where such modifications include significant changes that may affect Users’ rights in accordance with applicable legal standards.
